18 U.S.C. § 2257 and § 2257A Record-Keeping Requirements Compliance Statement
Tluxus is not a producer (primary or secondary) of any of the visual content found on or accessible through the Tluxus platform (the "Platform"). With respect to records required under 18 U.S.C. § 2257 and § 2257A, Tluxus operates as a provider of a platform and hosting/transmission service. Pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), Tluxus's role with respect to user-uploaded content is limited to the transmission, storage, retrieval, hosting, formatting, and/or translation of depictions created and uploaded by independent third-party creators.
Producer Obligations
Each creator who uploads, produces, or distributes content through the Platform is the "producer" of that content as defined in 18 U.S.C. § 2257 and the regulations at 28 C.F.R. § 75. Every creator is solely responsible for creating and maintaining the records required by law, including:
- Verifying, by examination of a valid government-issued photographic identification, that every individual depicted in any content was at least 18 years of age at the time the content was created;
- Maintaining records of the legal name, any stage or professional names, and date of birth of every individual depicted;
- Retaining these records as required by 18 U.S.C. § 2257 and 28 C.F.R. § 75.
As a condition of using the Platform, every creator represents and warrants that all individuals appearing in their content are 18 years of age or older and that the creator has obtained and retained the records required by law. This obligation is set out in our Terms of Service.
Zero Tolerance for Minors
Tluxus has a strict zero-tolerance policy toward any content depicting, or appearing to depict, minors. Any such content, and any content involving non-consensual activity, will be removed immediately upon discovery, the responsible account will be terminated, and the matter will be reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement.

For inquiries regarding records maintained pursuant to 18 U.S.C. § 2257 for content produced by Tluxus (where applicable), or to identify the appropriate record custodian for creator-produced content, please direct correspondence to the Tluxus Compliance / Custodian of Records:
