Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tluxus website, applications, and services (collectively, the "Platform"), operated by Tluxus ("Tluxus", "we", "us", or "our"). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access or use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. The Platform is not directed to and may not be used by minors under any circumstances.

2. Accounts

To use most features you must register for an account and provide accurate, current, and complete information. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Creator Content and Conduct

Tluxus enables creators to manage fan conversations and sell pay-per-view content. If you upload, transmit, or sell content ("Creator Content"), you represent and warrant that:

  • You own or have all necessary rights and licenses to the Creator Content;
  • Every person depicted in the Creator Content is at least 18 years old and consented to its creation and distribution, and you have retained records as required by 18 U.S.C. § 2257;
  • The Creator Content does not violate any law or third-party right, and does not contain prohibited content (see Section 4).

You retain ownership of your Creator Content. You grant Tluxus a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Creator Content solely as necessary to operate and provide the Platform.

4. Prohibited Content and Activities

You agree that you will not, and will not permit others to, use the Platform to:

  • Create, upload, or distribute any content depicting or involving minors, child sexual abuse material (CSAM), or anyone under 18 — this is strictly and permanently prohibited and will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement;
  • Post content depicting non-consensual acts, trafficking, bestiality, incest, or violence;
  • Impersonate any person, or post another person's private or intimate content without consent;
  • Engage in fraud, money laundering, or any illegal transaction;
  • Distribute malware, spam, or attempt to disrupt or gain unauthorized access to the Platform.

5. Payments, Platform Fee, and Payouts

Paid transactions on the Platform are processed by third-party payment processors. By purchasing or selling content, you also agree to the applicable processor's terms. Tluxus charges a platform fee of 25% on each pay-per-view sale; the remaining balance, less any processor fees, is remitted to the creator. Subscription plan fees (if any) are billed in advance and are described at the point of purchase.

6. Refunds and Chargebacks

Due to the digital nature of the content, all sales are generally final and non-refundable except where required by law or expressly stated otherwise. If you believe a charge was made in error, contact us at [email protected] before initiating a chargeback so we can resolve the issue.

7. Intellectual Property

The Platform, including its software, design, and trademarks, is owned by Tluxus and protected by intellectual-property laws. Except for your Creator Content, you may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

8. DMCA / Copyright

We respect intellectual-property rights and respond to valid notices of alleged infringement. See our DMCA Policy for how to submit a takedown notice or counter-notice.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLUXUS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Tluxus from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Creator Content, your use of the Platform, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Platform and request account deletion at any time.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
